Terms of Service
1. Agreement
These Terms of Service (“Terms”) are a contract between you and Driverpoint for the Driverpoint mobile application and related services (the “Service”).
By creating an account, tapping accept, or using the Service, you agree to these Terms and to the Privacy Policy at https://driverpoint.app/privacy (also in the app: More → Privacy Policy). If you do not agree, do not use the Service.
We may update these Terms. The version date will change. If you already have an account and the version changes, the app will ask you to accept again before you continue. Continued use after you accept the new version means you agree to it.

2. Who may use Driverpoint
You must be at least 18 years old and able to form a binding contract.
The Service is built for adult gig-economy drivers. You represent that you are legally allowed to do that work in the place where you use the app.
You must provide accurate registration information and keep your email reachable.
One person per account. You may not sell, share, or transfer your account. We may limit how many devices stay signed in at once.
3. The Service
Driverpoint shows crowdsourced, anonymous driver density (heatmap and peer dots) so you can decide where to work. It also includes zones and alerts, community street reports, shift mileage and optional earnings notes, Assist / SOS, partner offers, and related tools.
The map does not show your name or vehicle. Location you share with the shift ON is anonymized for other drivers. Peers and heat update with live ingest cadence and presence rules — not an artificial timed delay before others can see you.
Live radar requires your shift ON and Always / background location permission. If either is missing, the live radar stays locked by design.
The Service is a decision aid. It is not a dispatch, insurance, employer, or navigation product, and it is not affiliated with Uber, Lyft, DoorDash, Uber Eats, or any other platform named in the app.
We may change, suspend, or discontinue features. Crowdsourced data can be incomplete, delayed, or wrong. You remain responsible for how you drive and where you work.
4. Your account and security
You may register with email and a password, or Sign in with Google or Apple. You are responsible for activity on your account and for keeping credentials and the signed-in device under your control.
Tell us at legal@driverpoint.app if you believe the account was used without permission. We may revoke sessions, require re-verification, or close an account that looks compromised or abusive.
5. Location and your shift
When you turn the shift ON and grant the required location permission, you agree that approximate location will be used to contribute to and display the anonymous live radar, and to compute shift distance on our servers.
You can end the shift at any time. After the shift ends (and when presence TTL expires), you drop off the live radar.
Do not use the app in a way that violates traffic law. Looking at a phone while driving can be illegal. You agree to interact with the Service only when it is safe and lawful.
6. Driverpoint Pro, trial, and billing
Core product features require Driverpoint Pro (or an active introductory trial). Price on the stores is currently $1.99 USD per month, unless the store page shows a different local price or tax.
If you are eligible, Apple or Google may offer 30 days free (introductory offer) through RevenueCat. After the trial, the subscription auto-renews at the then-current monthly price unless you cancel.
Payment is charged to your Apple or Google account. The store is the merchant of record. We do not see or store your full card number.
Auto-renew: the store charges the renewal before the period ends. Cancel at least 24 hours before the end of the current period in the store subscription settings (iOS: Settings → Apple ID → Subscriptions; Android: Google Play → Payments & subscriptions). Deleting the app or the Driverpoint account does not by itself cancel the store subscription — cancel in the store as well.
Restore purchases on the same store account if you reinstall or change phones. A store subscription is tied to the store account and to the Driverpoint account that claimed it. You cannot freely move an active subscription between different Driverpoint accounts.
Refunds, billing disputes, and family sharing follow Apple’s and Google’s rules, not a separate Driverpoint refund desk.
We may change price or packaged features with notice required by the stores and by law. There is no “skip and use everything free” path.
7. Acceptable use
You agree not to: use the Service for unlawful stalking, harassment, or to identify a person on the map; scrape, overload, or reverse engineer the Service except as the law allows; open multiple accounts to evade a ban or a subscription; post false, defamatory, or illegal reports or comments; impersonate others; interfere with another driver’s safety; or use Assist as a joke or a threat.
We may remove content, disable features, or close an account if we reasonably believe these rules were broken.
8. Your content (reports, comments, zones, Assist)
You keep ownership of text you write. You grant Driverpoint a worldwide, non-exclusive, royalty-free license to host, display, and moderate that content so the Service can function (including showing a report and your name snapshot to other drivers in that city).
You represent that you have the right to post the content and that it does not violate the law or someone else’s rights.
Community reports are public to other Driverpoint users in the relevant city. Do not put phone numbers, addresses of private homes, or other sensitive personal data in a report.
We may moderate, hide, or remove content (including after a flag) and may restrict community features for abuse.
9. Assist / SOS — not emergency services
Assist lets you ask nearby drivers for help or connect with professional help. It is voluntary. It is not 911, 112, or any official emergency service. If you are in danger, injured, or need police, fire, or an ambulance, call the local emergency number first.
We do not guarantee that anyone will see, accept, or arrive. Response times, skills, and outcomes are outside our control. Professional partners are independent. Driverpoint is not their employer and is not liable for their work.
You use Assist at your own risk. Do not rely on it as your only safety plan.
10. Partner offers and third-party platforms
Rewards or partner links may earn Driverpoint a commission if you continue on the partner’s site. Those offers are from third parties. We do not control their prices, credit decisions, or fulfillment.
Naming Uber, Lyft, DoorDash, or similar apps does not mean those companies sponsor or endorse Driverpoint, or that we can see your trips or payouts inside those apps. Earnings you type into Driverpoint are numbers you choose to enter.
11. Privacy
How we collect and use personal data is described in the Privacy Policy (More → Privacy Policy, and https://driverpoint.app/privacy). That policy is part of your agreement with us.
You can delete your account and associated personal data in the app: More → Delete account. Cancel any store subscription separately if you do not want further charges.
12. Our intellectual property
The app, name, logos, map styling, and software are owned by Driverpoint or our licensors. These Terms do not give you any right to copy, resell, or build a competing service from our software or non-public APIs.
Map data and tiles may be provided by Mapbox and its data sources under their terms.
13. Disclaimer of warranties
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
We do not warrant that heat, peers, alerts, reports, mileage, or Assist will be accurate, complete, or available at any particular time. You use the Service at your own risk, including any decision to drive, wait, or accept help.
14. Limitation of liability
TO THE FULLEST EXTENT PERMITTED BY LAW, DRIVERPOINT AND ITS OPERATORS, OFFICERS, AND CONTRACTORS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, LOST FARES, FUEL, DOWNTIME, OR LOSS OF DATA, ARISING FROM THE SERVICE OR THESE TERMS.
OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID TO USE DRIVERPOINT PRO IN THE THREE MONTHS BEFORE THE CLAIM OR (B) TWENTY-FIVE U.S. DOLLARS (US $25), EXCEPT WHERE A LAW SAYS WE CANNOT LIMIT LIABILITY (FOR EXAMPLE, LIABILITY FOR DEATH OR PERSONAL INJURY CAUSED BY GROSS NEGLIGENCE WHERE THAT CANNOT BE WAIVED).
Some places do not allow certain limitations. In those places, our liability is limited to the maximum allowed.
15. Indemnity
You agree to indemnify and hold Driverpoint harmless from claims, damages, and reasonable legal fees arising out of your misuse of the Service, your content, your driving, or your breach of these Terms, except to the extent we caused the harm by our own gross negligence or willful misconduct.
16. Termination
You may stop using the Service and delete your account at any time (More → Delete account).
We may suspend or terminate access if you breach these Terms, if required by law, or if we discontinue the Service. We will try to give notice when it is reasonable and lawful to do so.
Sections that by nature should survive (including 12–15, 17–19) survive termination.
17. Apple App Store terms (iOS)
If you downloaded the app from Apple, you acknowledge that these Terms are between you and Driverpoint only, not Apple. Apple has no obligation to provide maintenance or support. If the app fails to conform to any applicable warranty, you may notify Apple and Apple may refund the app purchase price (if any); to the maximum extent permitted by law, Apple has no other warranty obligation. Apple is not responsible for claims relating to the app (including product liability, legal or regulatory failure, or consumer protection). Apple is not responsible for investigating, defending, or settling third-party intellectual-property claims. You represent that you are not in a U.S.-embargoed country and not on a U.S. denied-party list. Apple and Apple’s subsidiaries are third-party beneficiaries of this section and may enforce it against you.
18. Google Play (Android)
If you downloaded the app from Google Play, Google’s terms for the store also apply to the download and to Play Billing. Driverpoint, not Google, is responsible for the Service and for these Terms.
19. Governing law and disputes
These Terms are governed by the laws that apply to the operator of the Service, without regard to conflict-of-law rules, and without taking away mandatory consumer protections of the country or state where you live.
If a dispute cannot be resolved by email to legal@driverpoint.app, the courts with jurisdiction over the operator — or the courts required by mandatory consumer law in your place of residence — will hear it. We do not require you to waive a jury trial or to arbitrate unless a later version you accept says so and the law allows it.
20. General
If a court finds a part of these Terms unenforceable, the rest stays in force. These Terms and the Privacy Policy are the entire agreement for the Service. We may assign the agreement in a merger or sale of the Service. You may not assign it without our consent. A failure to enforce a right is not a waiver.
The English and Spanish versions are meant to say the same thing. If they ever conflict, the version you accepted in the language of the app at the time of acceptance will be used, unless a mandatory law requires otherwise.
